1. Acceptance of Terms
By using our services, you agree to be bound by these Terms & Conditions. All bookings are confirmed only upon written acceptance of quoted charges.
2. Third-Party Services
We are not liable for loss or damage caused by third-party carriers, agents, or warehouses unless we physically handle the goods. We select third parties with reasonable care but do not guarantee their performance.
3. Liability Limitations
When goods are in the custody of third parties, we are not liable for any loss, damage, or delay. Our liability is strictly limited as outlined in our terms.
4. Route and Agent Selection
We have full discretion to choose routes, carriers, and agents unless you provide specific written instructions. Advice about selected parties does not constitute a warranty.
5. Quotations Are Not Binding
All quotes are estimates and subject to change without notice. Only written confirmations of specific rates are binding.
6. Customer’s Duty to Provide Information
You must provide accurate and complete documentation for customs and compliance. We are not liable for penalties or delays caused by incorrect or incomplete information.
7. Declared Value and Insurance
Higher liability limits require prior written agreement and additional charges. Insurance is arranged only upon your written request and is subject to insurer acceptance.
8. Limitation of Liability
Our liability is limited to the lesser of $50 per shipment or the service fee charged. We are not liable for consequential or punitive damages.
9. Claims Period
Claims must be submitted in writing within 90 days of the incident. Legal action must be initiated within 6 months of claim submission.
10. Payment and Lien Rights
All charges are due immediately upon invoicing. We reserve a general lien on your goods for unpaid fees and may sell them after due notice if payment is not made.
11. Customer Indemnification
You agree to indemnify us against claims, fines, penalties, or legal costs arising from your shipments, including non-compliance with government regulations.
12. No Responsibility for Governmental Compliance
You are solely responsible for complying with all customs, FDA, and other regulatory requirements. We are not liable for fines or penalties due to your non-compliance.
13. Governing Law and Venue
These terms are governed by the laws of the state where our servicing office is located. Legal disputes must be filed in that state’s courts.
